North Korea / Human rights: UN Expert in fact-finding mission to Seoul

GENEVA / SEOUL (14 July 2017) – The United Nations Special Rapporteur on the situation of human rights in the Democratic People’s Republic of Korea (DPRK), Tomás OJEA QUINTANA, will visit Seoul from 17 to 21 July. 

Since his appointment by the UN Human Rights Council in March 2016, the Special Rapporteur has not been granted access to the DPRK, despite the requests made. As part of his efforts to gather information on the situation of human rights in the DPRK, Mr. OJEA QUINTANA has previously visited Japan and the Republic of Korea, in November 2016. 

“With the new administration in the Republic of Korea now in place, the purpose of my mission is to hear from them about the new policies vis-à-vis the DPRK, and to collect first-hand information on human rights from various sources, including people who have recently left the country,” said the independent expert. 

“My visit comes in the context of intensified hostilities in the region and with that, increased international scrutiny, including from the UN Security Council,” the expert added. 

“Human rights are obviously under threat as tension rises and efforts to promote dialogue must address human rights concerns. It is part of my mandate to remind Governments of this important principle,” he underscored. 

During the five-day mission, the Special Rapporteur is expected to meet with senior members of the Government as well as the representatives of the civil society and other stakeholders. 

Mr. OJEA QUINTANA will hold a press conference on 21 July, from 14:00-15:00 (local time) in Seoul. Further details to be announced locally. Access to the press conferences is strictly limited to journalists. 

The Special Rapporteur will report his findings and recommendations to the General Assembly in October 2017.

Mr. Tomás OJEA QUINTANA (Argentina) was designated as the Special Rapporteur on the situation of human rights in the DPRK by the UN Human Rights Council in 2016. Mr. Ojea Quintana, a lawyer with more than 20 years of experience in human rights, worked for the Inter-American Commission of Human Rights, and represented the Argentinian NGO “Abuelas de Plaza de Mayo” in cases concerning child abduction during the military regime. He is a former Head of OHCHR human rights programme in Bolivia, and served as the UN Special Rapporteur on the situation of human rights in Myanmar from 2008 to 2014. 

The Special Rapporteurs are part of what is known as the Special Procedures of the Human Rights Council. Special Procedures, the largest body of independent experts in the UN Human Rights system, is the general name of the Council’s independent fact-finding and monitoring mechanisms that address either specific country situations or thematic issues in all parts of the world. Special Procedures’ experts work on a voluntary basis; they are not UN staff and do not receive a salary for their work. They are independent from any government or organization and serve in their individual capacity.

조선민주주의인민공화국 / 인권유엔 전문가 정보 수집임무를 띄고 방한

                                                                                
제네바/서울 (2017 7 14) – 조선민주주의인민공화국  인권에 관한 특별보고관(이하 “특별보고관”) 토마스 오헤아 퀸타나가 7 17일부터 21일까지 대한민국을 방문한다

특별보고관은 2016 3 유엔 인권이사회에서 임명된 이후조선민주주의인민공화국방문을 여러 차례 요청하였으나 아직 방문이 허용되지 않았다특별보고관은 조선민주주의인민공화국  인권 상황 관련 정보를 수집하고자 2016 11 일본과 대한민국에 방문했다

특별보고관은 “대한민국에  정부가 취임한 시점에서 이번 방한은  정부의 조선민주주의인민공화국 관련 정책에 대해 듣고근래에 탈북한 이들을 포함하여 여러 출처로부터직접 인권 상황 관련 정보를 수집하기 위함이라고 말했다.   

근래 역내 적대감이 고조되고그에 따라 유엔 안전보장이사회를 비롯하여 국제적인 관심도 더해지는 상황에서 방한하게 되었다” 

긴장이 고조되면서 인권 침해 위험이 더욱 커지고 있다. 대화를 추진할  인권 문제도 반드시 다루어야 한다관련 정부에 이러한 중대한 원칙을 상기하는 것도 특별보고관 임무라고 강조했다

특별보고관은 5 간의 방한 동안 정부 고위관계자를 비롯하여시민사회 대표자  여러이해관계자를 만날 예정이다

방한을 마무리하는 7 21 서울에서 (현지 시간 기준오후 2시부터 3시까지 기자회견을 갖는다. 기자회견 출입은 언론관계자로만 제한한다

특별보고관은 방한 내용  권고를 2017 10 유엔 총회 제출 보고서에 반영할 예정이다

 

토마스 오헤나 퀸타나 (아르헨티나) 조선민주주의인민공화국  인권 상황에 관한 특별보고관으로 2016 유엔 인권이사회 임명을 받았다인권 분야에서 20 이상의 경력을 쌓은 변호사로 미주인권위원회에서변호사로 근무했으며아르헨티나 군부 독재 시절 아동 납치 문제를 다룬 비정부기구 마요 광장의 어머니들(Abuelas de Plaza de Mayo) 대표로도 활동했다볼리비아  유엔인권최고대표사무소 인권 프로그램을 총괄한  있으며, 2008년부터 2014년까지 미얀마  인권에 관한 특별보고관직을 역임했다


특별보고관은 유엔 인권이사회 특별절차제도특별절차는 유엔 인권 제도 하에서 가장 많은 수의 독립전문가가 참여한다특별절차는 특정국가 인권 또는 전세계에 적용하는 특정 인권 주제를 다루기 위해 인권이사회가 독립적으로 사실 관계를 규명하고 모니터링하는 제도를 가리킨다.특별절차 전문가는 유엔 직원 신분이 아니고 무보수로 자발적인 임무를 수행한다또한 여타 정부나 기관으로부터 독립성을 유지하며 개인 역량을 바탕으로 업무를 수행한다.
